IL Probate Forms

There are a number of state-specific forms you may need when going through the probate process.

General Forms

In Illinois, the local Circuit Court handles wills and estate probate.

You can check with your local court for the forms they might prefer, and below you will find some of the more common IL forms:

  1. Petition for Probate - Get the probate process started
  2. Notice to Heirs - Notify heirs that probate is underway
  3. Petition for Letters of Administration - Get the probate process started with no will
  4. Notice to Interested Parties - Notify parties that administration has been applied for
  5. Designation of Resident Agent - Tell the court you have an in-state representative
  6. Acceptance of Office of Personal Representative - Tell the court you accept the executor role
  7. Inventory - List estate contents for the court (you may be able to attach the EstateExec Inventory Report)
  8. Final Report - Submit this Closing Statement to tell the court the settlement is complete
  9. Receipt On Distribution - You can ask heirs to sign this when they receive their shares of the estate
  10. Notice of Final Report - Send to heirs

The above forms are provided by Cook County: see Cook County Probate Forms (select Probate Division) for a more complete list of forms that may be required in certain situations, and check with your local court to determine whether they have their own equivalent forms (for example, see Will County Probate Forms), or will allow you to use Cook County's, or would prefer you make a document of your own.
