Probate Forms (ON)
There are a number of province-specific forms you may need when going through the probate process.
This page lists common ON forms and offers help in locating others. While you are welcome to browse these forms, note that the Tasks Tab will guide you through the use of relevant forms at the appropriate times.
General ON Forms
In Ontario, estate probate is handled by the Superior Court of Justice in the county or district in which the decedent lived.
Below you will find links that allow you to download and use some of the more common ON probate forms (you may want to check with your local court for form preferences):
- Application for Certificate of Appointment of Estate Trustee (Form 74A) - Get the probate process started
- Affidavit of Service of Notice (Form 74B) - Tell the court you notified the heirs
- Affidavit of Execution of Will (Form 74D) - Support the validity of the will
- Renunciation (Form 74G) - Include from anyone with equal or higher priority to serve as trustee
- Consent & Bond Waiver (Form 74H) - Apply for bond waiver if no will
- Draft Order (Form 74I) - Include with Form 74H
- Certificate of Appointment (Form 74C) - Include draft with your application
- Reseal Appointment (Form 74J) - Apply to use executor appointment made elsewhere
- Estate Trustee Bond - Company (Form 74L) - Show court you have obtained any required bond (from a company)
- Estate Trustee Bond - Person (Form 74M) - Show court you have obtained any required bond (from a person)
- Estate Information Return (Form 9955E) - Provide to Ministry of Finance
- Affidavit Verifying Estate Account (Form 74.43) - You may want to attach EstateExec's Accounting Report
- Notice of Application to Pass Accounts (Form 74.44) - Notify interested parties you have applied to pass accounts

Small estates sometimes need only 1 specialized form or affidavit: see Small ON Estates.
Resealing
If the estate needs to probate real estate in another province, you may be able to reseal the original grant of probate rather than start from scratch in the secondary province: see Ancillary Probate & Resealing.
