Executor Compensation and Fees (PR)

If the will does not specify how executor compensation should be calculated, PR estates must follow state compensation rules.

In Puerto Rico, if the will does not specify an amount for executor remuneration, then the heirs can either agree on amount, or the court will set an amount.

The maximum amount the will or the court can set is equal to 10% of the income or net product of the estate.

Note that if the will does not specify executor compensation, but does include a bequest for the executor, that bequest is considered to be in payment for any executor commission.
