Executor Compensation and Fees (AS)
If the will does not specify how executor compensation should be calculated, AS estates must follow state compensation rules (see AS calculator below).
American Samoa law holds that the executor fee should not exceed 2.5% of receipts (basically, assets and any income), plus an amount not to exceed 2.5% of disbursements (expenses paid and heir distributions), with a minimum fee of $40.
So, for example, an American Samoa estate worth $5K at the time of death, and with $4K to distribute, would generate at most $225 in executor fees, and one worth $600K at time of death and $700K at time of distribution would generate at most $32,500 in executor fees.
Assets that pass directly to named beneficiaries, such as life insurance policies or 401Ks, are not included in these calculations.
